Data Protection Workshops Series - 2005

On the day following the annual Data Protection Compliance Conference we will be hosting several half-day workshops.  The aim of the Workshops is to provide delegates with an opportunity to examine a practical scenario with respect to data protection compliance. 

Papers relating to the scenario will be distributed to delegates prior to the Workshop and delegates are encouraged to bring their own additional questions to the session.  Each Workshop will be hosted by one or more legal experts in the relevant field.

Targeting Customers in the Virtual World
Stella Cramer and Jane Finlayson-Brown ( 9.30am – 12.45pm )

Getting messages across to potential customers becomes more challenging with ever more regulation in this crucial area of compliance. This Workshop covers the practical implications of the E-Commerce Directive, the Data Protection Directive; the Privacy and Electronic Communications Directive, the E-Signatures Directive and the implementing UK legislation.

This Workshop will include practical analysis of:

  • information disclosure requirements;

  • steps to take when contracting online;

  • cancellation rights;

  • e-signatures;

  • data protection compliance;

  • use of cookies and spamming.

Data Protection Compliance as a Strategic Issue
Bridget Treacy ( 9.30am – 12.45pm )

In a changing regulatory landscape, data protection compliance is fast attracting board level attention. Recent high profile transgressions, particularly in the financial services sector, and the negative publicity which inevitably follows, have propelled data protection and privacy higher up the compliance agenda. Businesses are increasingly aware of the commercial value of personal data and of the consequences of failing to reassure individuals that their information is processed fairly and in accordance with their rights.

This interactive Workshop, led by Bridget Treacy of Barlow Lyde & Gilbert, will address the following issues:

Achieving Data Protection Compliance

  • The starting point
  • The practicalities
  • The cost effective way of dealing with compliance
  • The additional implications for regulated industries

Policy Considerations

  • Drafting a meaningful Data Protection policy
  • Reconciling the demands of customers and staff with business needs
  • Practical tips

Retention of Data

  • For how long should personal data be retained?
  • How can Principle 5 be reconciled with other regulatory requirements?
  • How can a workable retention policy be developed?

International Data Transfers - From Model Clauses to Binding Corporate Rules
Eduardo Ustaran ( 2.00pm – 5.15pm )

The ban on transfers of data to unsafe jurisdictions has been an ongoing problem for many international organisations since the 1995 Data Protection Directive was adopted. In practice, there are a number of ways to overcome this problem, but finding the right solution can be a difficult decision to make.

This workshop, led by one of the UK’s leading data protection experts, will focus on the different options and provide practical guidance on how to implement the right one. It will include:

  • Negotiating model clauses
  • Identifying contractual pitfalls
  • Drafting Binding Corporate Rules
  • Obtaining regulatory approval for data exports

Handling Requests for Information
Stewart Room ( 2.00pm – 5.15pm )

This workshop will provide practical advice and assistance to participants who handle request for information under the Data Protection and/or Freedom of Information Acts, with the prime focus being rejection or refusals of requests.  Issue covered include:

  • Identifying the appropriate legal regime applicable to the request

  • The wider legal framework within which requests for information sit, including public law principles, natural justice and judicial review

  • Assessing the risks, prioritising requests and the drivers to regulatory intervention

  • Drafting responses

  • Knowing how to say no


 

::  Each Workshop is accredited by the Law Society with 3 CPD points.

Anyone can attend the Workshops and there is no requirement to attend the Conference in order to join a Workshop. Attendance at the Workshops by Conference delegates is optional but it is anticipated that most Conference delegates will wish to attend one or more Workshops.

The fee for each individual Workshop will be £350 plus VAT ( Currency Converter ). 

A discount is available for attending two Workshops.  A further discount is available for delegates attending the Conference plus one or more Workshops.
