Direct marketing - Legal Risks and How to Overcome Them  Courses available in London

All types of organisations aim to promote their products and services as widely as possible.  However, the sending of marketing materials to individuals ( direct marketing ) is heavily regulated both in the UK and in the European Union.  This presents serious risks that can affect a brand's value and consumer trust.

This Training course provides a practical hands-on approach to the variety of different legal rules for direct marketing by post, fax, telephone, text message and email.  Attend this Training course to gain peace of mind that your direct marketing campaigns will meet the necessary legal requirements.

The Training course will address the practical questions that marketing departments face in devising lawful marketing campaigns.  It will deal with such concerns as:

  • what types of communication constitute ‘marketing’

  • how the choice of media (email, text message, fax, telephone, post) affects the conduct of the marketing campaign

  • the distinction between targeting corporate entities and individuals

  • a detailed consideration of the purpose and effect of opt-out and opt-in clauses

  • how to draft opt-in an opt-out clauses to achieve desired outcomes

  • the requirements of the Privacy & Electronic Communications (EC Directive) Regulations 2003, including a detailed analysis of the exemption from the opt-in requirement for email marketing campaigns

  • the information that must be included in direct marketing materials

  • using a legacy database

  • using marketing lists purchased from third parties

Course Content:
Training course participants will understand how to conduct successful and lawful direct marketing campaigns.

 

The Trainer

 

Eduardo Ustaran is head of FFW's Privacy and Information Law Group and an internationally recognised expert in privacy and data protection law. 

 

A dually qualified English Solicitor and Spanish Abogado, Eduardo specialises in the legal issues that derive from the use of information technology and the Internet.

Eduardo advises on the impact of EU data protection and e-commerce law on the operational activities of all types of organisations, including FTSE 100 companies and public sector bodies.
