FOI and Data Protection – How They Work Together (Scotland)


Course available in Edinburgh and Glasgow, Scotland

The competing demands of freedom of information and data protection legislation present challenges for all public bodies involved in collecting, holding and disclosing personal information.  Understanding the interface between the Freedom of Information Act 2000, the Freedom of Information ( Scotland ) Act 2002 and the Data Protection Act 1998 is essential for all those who have FOI and DP compliance roles in relation to public sector employees, clients and customers.

This Training course will explain the key legal principles which govern when personal data should and should not be released in response to subject access requests and FOI requests.  The session will also examine recent decisions of the Scottish and UK Information Commissioners concerning the release of personal data and will offer practical advice on managing these increasingly frequent requests.  It will include:

  • Definition of Personal Data - the impact of the House of Lords decision in CSA v Scottish Information Commissioner and other recent developments
  • Knowing whether a request should be dealt with under the DPA or FOIA
  • The legal principles governing access to third party personal data
  • Applying the data protection principles and other relevant exemptions
  • Applying relevant exemptions
  • Disclosing staff information to outside third parties
  • Analysing key decisions of the Information Commissioner, the Scottish Information Commissioner and the Courts

This Training course will enable delegates to understand how to manage requests for personal data and to achieve best practice within their organisation.

Topics covered include:

  • An overview of the Data Protection Act and FOI provisions on access to personal data and third party personal data
  • The definition of 'personal data' and recent developments
  • How to classify requests for personal data and third party personal data
  • The interface between the DPA and the FOI Acts
  • Comparing timescales, fees and other practical aspects of dealing with requests
  • Managing requests from within your organisation – especially from employees – and from outside it
  • Relevant Commissioner and Court decisions including the Common Services Agency v Scottish Information Commissioner

Delegates are encouraged to share their own experiences at the training course.

The day will be a mixture of presentation and practical exercises.  There will be plenty of opportunity for questions.
